RICS Party Walls and Boundaries Essential Update
By Andrew Jackson and Martin Penney
Technics recently attended the RICS Party Walls and Boundaries Essential Update at the Holiday Inn, Kensington. The seminar was well attended by industry professionals involved in this complex area, which bridges many divisions of Survey and the Law.
Essential update seminars such as this are critical for individuals to maintain their high standards of professionalism, competence and currency, and to ensure that companies such as Technics are aware of the key industry and legal thinking that affects and guides their commercial services.
Thespian performances
Guest lecturers from amongst Morrisons Solicitors LLP, Calvert Consulting and Anstey Horne advised on the latest developments in case law, party walls and boundary identification and disputes. The audience was also treated to a staged escalating development dispute over a Right to Light issue delivered by Wonnacott QC and Holmes from Wilberforce Chambers. This proved amusing entertainment but also reinforced the pitfalls and intricacies of such potential infringements and disputes.
I see no dispute
Calvert, the keynote Boundary Dispute lecturer, erstwhile of the Ordnance Survey and Military Survey, confirmed the fundamental need to understand the practicalities of the evidence on the ground and any available mapping, but also to confirm evidence and not make assumptions. Land use changes many times and it canβt always be understood from the visual inspection alone. Moreover, the investigation and evaluation of many practical data and information sources is crucial. The role of the survey expert is to put forward the conflation of this evidence in as lucid and unbiased fashion as possible. Sound advice for the professional community.
